How Personal Injury Settlements Are Calculated

Our personal injury calculator uses established formulas to estimate potential settlement values. The calculation considers both economic damages (medical expenses, lost wages) and non-economic damages (pain and suffering).

Calculation Formulas
Base Damages = Medical Expenses + Lost Wages + Future Medical Costs + Other Damages
Pain & Suffering = Base Damages × Multiplier
Gross Settlement = Base Damages + Pain & Suffering
Final Estimate = Gross Settlement × (1 - Comparative Fault %)
Example Calculation

With medical expenses of $15,000, lost wages of $5,000, future medical costs of $10,000, other damages of $2,000, a multiplier of 1.5, and 20% comparative fault:

  • Base Damages = $15,000 + $5,000 + $10,000 + $2,000 = $32,000
  • Pain & Suffering = $32,000 × 1.5 = $48,000
  • Gross Settlement = $32,000 + $48,000 = $80,000
  • Final Estimate = $80,000 × (1 - 0.20) = $64,000
Understanding Multipliers

The pain and suffering multiplier accounts for non-economic damages. More severe injuries typically warrant higher multipliers:

  • Minor injuries: 1.0-1.5 (minor sprains, small cuts)
  • Moderate injuries: 1.5-3.0 (fractures, significant sprains)
  • Severe injuries: 3.0-5.0+ (major fractures, head injuries)
